Article 1 (Purpose)

These Terms and Conditions govern the rights, obligations, and responsibilities between Epic Tours Korea (“the Company”) and customers (“Participants”) in relation to guided birding tours, nature interpretation services, photography-related experiences, and other related services provided by the Company.

Article 3 (Scope of Services)

  1. The Company provides guided birding tours and nature interpretation services primarily focused on bird observation, photography, and education.

Article 4 (Reservations and Payment)

  1. Reservations must be made through the Company’s website or an approved booking platform.

  2. Payment must be completed in full prior to the tour unless otherwise agreed in writing.

  3. Prices are listed in USD and KRW unless stated otherwise and may include applicable taxes where required by law.

  4. The Company reserves the right to refuse or cancel a reservation if payment is incomplete or fraudulent activity is suspected.

Article 5 (Cancellations and Refunds)

  1. Participant-initiated cancellations:

    • Cancellations made 48 hours or more before the scheduled tour: full refund

    • Cancellations made less than 48 hours before the scheduled tour: no refund

  2. Company-initiated cancellations:

    • The Company may cancel a tour due to weather conditions, safety concerns, guide illness, or other unavoidable circumstances.

    • In such cases, Participants will receive a full refund or may reschedule.

  3. No refunds will be issued for late arrivals or no-shows.

Article 6 (Transportation Disclaimer)

  1. The Company does not provide transportation services for compensation but may utilize third party transportation companies.

  2. Participants are responsible for arranging their own transportation to and from tour meeting points.

  3. Any informal ride-sharing or incidental transport, if it occurs, is not a paid service and is provided without obligation or liability.

Article 7 (Participant Responsibilities)

  1. Participants must follow the guide’s instructions at all times for safety and environmental protection.

  2. Participants are responsible for:

    • Their own health and physical condition

    • Appropriate clothing and equipment

    • Personal belongings

  3. The Company may refuse participation or remove a Participant from a tour if their behavior:

    • Endangers themselves or others

    • Harms the local ecology

    • Disrupts the tour

    • Violates laws or site regulations

    In such cases, no refund will be issued.

Article 8 (Assumption of Risk)

  1. Outdoor and nature-based activities involve inherent risks, including but not limited to:

    • Uneven terrain

    • Weather changes

    • Wildlife encounters

  2. Participants acknowledge and accept these risks and agree to participate at their own responsibility.

Article 9 (Limitation of Liability)

  1. To the maximum extent permitted by Korean law, the Company shall not be liable for:

    • Personal injury, illness, or death not caused by the Company’s gross negligence

    • Loss or damage to personal property

    • Delays or disruptions caused by weather, natural conditions, or third parties

  2. The Company’s total liability, if any, shall not exceed the amount paid by the Participant for the relevant service.

Article 10 (Insurance)

  1. The Company may maintain general liability insurance where applicable.

  2. Participants are strongly encouraged to obtain their own travel and medical insurance.

Article 11 (Photography and Media Use)

  1. During tours, photos or videos may be taken for promotional or documentation purposes.

  2. By participating, Participants consent to the use of such media unless they explicitly request otherwise in writing before the tour.

  3. The Company will not use images in a way that infringes upon personal dignity or privacy.

Article 12 (Personal Information Protection)

  1. The Company collects and uses personal information solely for:

    • Reservation management

    • Customer communication

    • Legal and accounting purposes

  2. Personal information will be handled in accordance with applicable Korean data protection laws.

  3. Details are governed by the Company’s separate Privacy Policy.

Article 13 (Governing Law and Jurisdiction)

  1. These Terms and Conditions shall be governed by the laws of the Republic of Korea.

  2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Korea.

Article 14 (Amendments)

  1. The Company may revise these Terms and Conditions as necessary.

  2. Updated terms will be posted on the Company’s website, and continued use of services constitutes acceptance of the revised terms.

Article 15 (Miscellaneous)

If any provision of these Terms is found invalid under applicable law, the remaining provisions shall remain in full force and effect.

Acceptance

By booking or participating in a service provided by Epic Tours Korea, the Participant acknowledges that they have read, understood, and agreed to these Terms and Conditions.

제1조 (목적)

본 약관은 Epic Tours Korea(이하 “회사”)가 제공하는 조류 관찰 가이드 투어, 자연 해설 서비스, 사진 관련 체험 및 이에 부수하는 서비스(이하 “서비스”)의 이용과 관련하여 회사와 고객(이하 “참가자”) 간의 권리, 의무 및 책임사항을 규정함을 목적으로 합니다.

제3조 (서비스의 내용 및 범위)

회사는 조류 관찰, 사진 촬영 및 교육을 중심으로 한 가이드 동반 조류 관찰 투어 및 자연 해설 서비스를 제공합니다.

제4조 (예약 및 결제)

  1. 서비스 예약은 회사의 공식 웹사이트 또는 회사가 승인한 예약 플랫폼을 통해 이루어져야 합니다.

  2. 별도의 서면 합의가 없는 한, 서비스 이용 요금은 투어 시작 전에 전액 결제되어야 합니다.

  3. 요금은 달러(USD) 및 원화(KRW)로 표시될 수 있으며, 관련 법령에 따라 세금이 포함될 수 있습니다.

  4. 회사는 결제가 완료되지 않았거나 부정 결제가 의심되는 경우 예약을 거절하거나 취소할 수 있습니다.

제5조 (취소 및 환불)

  1. 참가자에 의한 취소

  • 투어 시작 48시간 이전 취소 시: 전액 환불

  • 투어 시작 48시간 이내 취소 시: 환불 불가

  1. 회사에 의한 취소

  • 기상 악화, 안전 문제, 가이드의 질병 또는 기타 불가피한 사유로 투어가 취소될 수 있습니다.

  • 이 경우 참가자는 전액 환불 또는 일정 변경을 선택할 수 있습니다.

  1. 기타

  • 지각 또는 무단 불참(No-show)의 경우 환불은 제공되지 않습니다.

제6조 (교통 관련 고지)

  1. 회사는 유상 운송 서비스를 제공하지 않으며, 필요 시 제3자 운송 업체를 이용할 수 있습니다.

  2. 참가자는 투어 집결 장소까지의 이동에 대해 스스로 책임을 집니다.

  3. 투어와 무관하게 발생하는 비공식적 동승 또는 부수적인 이동은 유상 서비스가 아니며, 이에 대해 회사는 법적 책임을 지지 않습니다.

제7조 (참가자의 의무)

  1. 참가자는 안전 및 환경 보호를 위해 투어 진행 중 가이드의 지시에 따라야 합니다.

  2. 참가자는 다음 사항에 대해 본인의 책임 하에 참여합니다.

    • 개인의 건강 상태 및 신체 조건

    • 적절한 복장 및 장비 준비

    • 개인 소지품의 관리

  3. 참가자가 다음 각 호에 해당하는 경우 회사는 참가를 거부하거나 투어 중 퇴장을 요청할 수 있으며, 이 경우 환불은 제공되지 않습니다.

    • 본인 또는 타인의 안전을 위협하는 행위

    • 지역 생태계에 피해를 주는 행위

    • 투어 진행을 방해하는 행위

    • 관련 법령 또는 현장 규칙을 위반하는 행위

제8조 (위험 인지 및 책임)

  1. 야외 및 자연 기반 활동에는 다음과 같은 고유한 위험이 포함될 수 있습니다.

    • 고르지 않은 지형

    • 기상 변화

    • 야생 동물과의 접촉 가능성

  2. 참가자는 이러한 위험을 인지하고, 본인의 책임 하에 서비스에 참여함에 동의합니다.

제9조 (책임의 제한)

  1. 대한민국 법령이 허용하는 최대 범위 내에서, 회사는 다음 사항에 대해 책임을 지지 않습니다.

    • 회사의 고의 또는 중과실이 없는 경우의 신체 상해, 질병 또는 사망

    • 개인 소지품의 분실 또는 파손

    • 기상, 자연 조건 또는 제3자 사유로 인한 지연이나 서비스 중단

  2. 회사의 책임이 인정되는 경우에도, 그 책임 한도는 해당 서비스에 대해 참가자가 실제로 지급한 금액을 초과하지 않습니다.

제10조 (보험)

  1. 회사는 필요에 따라 일반 책임 보험에 가입할 수 있습니다.

  2. 참가자는 개인 여행자 보험 및 의료 보험에 가입할 것을 강력히 권장합니다.

제11조 (사진 및 영상 사용)

  1. 투어 진행 중 홍보 또는 기록 목적의 사진 및 영상이 촬영될 수 있습니다.

  2. 참가자는 투어 시작 전 서면으로 거부 의사를 명시하지 않는 한, 해당 자료의 사용에 동의한 것으로 간주합니다.

  3. 회사는 참가자의 인격권 및 사생활을 침해하는 방식으로 해당 자료를 사용하지 않습니다.

제12조 (개인정보 보호)

  1. 회사는 다음의 목적에 한하여 개인정보를 수집 및 이용합니다.

    • 예약 관리

    • 고객 응대 및 커뮤니케이션

    • 법적 및 회계 목적

  2. 개인정보는 대한민국의 관련 법령에 따라 안전하게 처리됩니다.

  3. 자세한 사항은 회사의 별도 개인정보처리방침에 따릅니다.

제13조 (준거법 및 관할)

  1. 본 약관은 대한민국 법률을 준거법으로 합니다.

  2. 본 약관과 관련하여 발생하는 모든 분쟁은 대한민국 법원을 전속 관할로 합니다.

제14조 (약관의 변경)

  1. 회사는 필요 시 본 약관을 변경할 수 있습니다.

  2. 변경된 약관은 회사 웹사이트에 게시되며, 게시 이후 서비스를 이용하는 경우 변경 사항에 동의한 것으로 간주합니다.

제15조 (기타)

본 약관의 일부 조항이 관련 법령에 따라 무효로 판단되더라도, 나머지 조항은 계속 유효합니다.

Epic Tours Korea의 서비스를 예약하거나 이용하는 경우, 참가자는 본 약관의 내용을 읽고 이해하였으며 이에 동의한 것으로 간주합니다.
